Understanding Landlord Rights During a Texas Eviction

As a landlord in Texas, you have specific legal rights when it comes to evicting a tenant. Understanding these rights — and their limits — is essential for protecting your property investment while staying on the right side of the law.

You have the right to evict a tenant for nonpayment of rent, violation of lease terms, holdover tenancy (staying past the lease end date), unauthorized occupants on the property, or any other legal ground specified in your lease agreement. Texas is relatively landlord-friendly compared to many states.

You have the right to collect unpaid rent and damages through the eviction process. In addition to possession, the court can award a money judgment for rent owed and any damages beyond normal wear and tear.

You have the right to reasonable access to the property for repairs and inspections, typically with 24 hours' notice (unless there's an emergency). However, you cannot use access as a tool to harass or intimidate a tenant.

You have the right to enforce all provisions of a valid lease agreement. If the lease prohibits pets, subletting, or specific activities, violations of these terms can be grounds for eviction.

However, you do NOT have the right to retaliate against a tenant for exercising their legal rights (such as requesting repairs or filing complaints with code enforcement). Under Texas Property Code §92.331, retaliatory evictions can be dismissed and may expose you to liability.
